OPEN SOURCE SOCIETY (Hereafter OSC), promotor of GOTEO complies with the requirements established in the law 34/2002, of 11 July, of services of the information society and electronic commerce, and the law 56/2007, of 28 December of measures to promote the information society, as well as the organic law 15/1999, of 13 December, on protection of data of a Personal nature and its implementing regulations (RD 1720/2007, of 21 December, approving the regulation on development and organic law 15/1999 of protection of Personal data) to that end has created the following conditions of use:

OPEN SOURCE SOCIETY

The present conditions of use regulate the access and the use of the platform, including the contents and services available to users in and/or through the community, either by the Foundation, either by their users, or by any third party.

Also, within the platform there is a possibility that the user access to the area to create or support projects, shall be subject to particular conditions.

FIRST: OBJECT OF THE SERVICE

GOTEO mainly offers a free service where registered users can access an open platform to propose or support projects of entrepreneurs, creative, and social innovators as well as putting in contact users of the platform.

SECOND: CONDICIONS

The use of GOTEO will be subject to the following conditions, which may be updated periodically, however GOTEO will send notice of the modification of the General conditions or the privacy policy. If the User decides not to accept the Conditions he(she) will have to abstain from gaining access and/or to use of the contents and/or services offered in the platform.

GOTEO reserves the right to improve, modify or suppress, unilaterally and without prior notice, services and/or contents of the said community according to different criteria.

Obligation to make proper use of the portal: The User undertakes to make proper use of the platform and to not use it for illegal activities or contrary to good faith and the law (merely indicative and not exhaustive); to provoke damages in the physical and logical systems of the person in charge, of its providers or of third persons, to introduce or to spread in the network computer viruses or any other physical or logical systems that are capable of provoking the damages previously mentioned,not to mention all those who violate or contravene the honour, person or family and privacy of persons, of the rights of property and of anything else belonging to a third party as a consequence of the transmission, dissemination, storage, making available, reception, obtaining or access to the contents or the image of third parties;the realization of acts of disloyal competition and illicit publicity as a consequence of the transmission, dissemination, storage, availability, reception, obtaining or access to the contents; the lack of veracity, accuracy, completeness, relevance and/or currency of the contents leaving the user, in any case, GOTEO harmless against any claim, judicial or extrajudicial.

The User is solely in charge of the contents and files put at his disposal in the portal, for it he promises not to publish (or to upload) any file (video, audio, text, etc.) that is subject to rights of intellectual property (or industrialist) of third parties, unless the legal holder of the above mentioned rights has granted him a license or formal authorization in accordance with the license that applies currently in the portal.

GOTEO excludes any liability for damages of any nature that may be due to the content provided or supplied by any third parties.

Use and custody of the user name and password. The User undertakes to make diligent use of the password and user name and to keep both in secret. It will be the sole responsibility of the user to maintain the confidentiality of your password, assuming therefore all the damages, expenses and/or damages of all kinds stem from the breaking of this obligation or of the revelation of the password, as well as the misuse that, as a result of the infringement of their duty of care, a third party could make.

Cancellation of access, services and contents. GOTEO may, at its sole discretion, refuse, withdraw, suspend, and/or block at any time and without prior notice the access to the content or to the platform itself to those users that do not comply with these conditions, you can remove your account and all the information and files pertaining to the same or, in his case, deny him access to such files or the platform itself. GOTEO does not assume any responsibility for the cancellation of access to the platform. GOTEO reserves the right to limit, total or partially, the access to certain users, as well as to cancel, suspend, block or delete certain type of content through the use of technological tools suitable to that effect, if it had actual knowledge that the activity or the information stored and/or broadcast is illegal or that it violates property or rights of a third party.

Also the User who considers it to be opportune has the possibility, of informing GOTEO of those contents/users who may be violating these conditions. In case that GOTEO verifies the veracity of the above mentioned denunciations it will be able, according to the established in the previous paragraphs to erase / cancel the denounced contents / users.

Communication and notifications: All the communications and realized notifications will be considered to be effective for all purposes when conducted through electronic mail to the e-mail address that the user could have given. The user acknowledges that these data have been supplied by himself and are entirely truthful.

Unsubscribe from the platform: In the event that the user wants to unsubscribe from the platform you can do it with the checkbox for that purpose. In that case your profile will be deleted while the content uploaded by the user will remain in the same.

THIRD: INTELLECTUAL AND INDUSTRIAL PROPERTY

Content, as well as the information covered by intellectual property whose ownership corresponds to GOTEO or registered users making the goods available at the platform (except if you deliberately pecify otherwise) may be reproduced, communicated publicly, transformed, or be drawn freely on a non-exclusive, totally or partially, by any person, in any format, without any restriction or temporary territorial and, for any legitimate use later, under the following conditions: You must always be given, and, in any case, the question of authorship and shall share equally in compliance with license Creative Commons 3.0 By - SA that governs in this platform.

In addition to being a platform dedicated to the Commons, the characteristic of the projects that are proposed and supported through it, is the choice of open licenses being the choice of the user who proposed the project from a listing proposed by the makers of GOTEO.

As for the rights of industrial property that could correspond to the above mentioned contents, as well as all brands, commercial names or any other distinctive signs are property of GOTEO or of their legitimate owners, and all rights remain reserved.

GOTEO is not liable for any loss which may arise from the use of the contents, services and information included in this web site by users or of the infringement by those of any existing legal provision.

FOURTH: MINORS

Full responsibility in determining the specific content and services to which minors have access under whose care the minors are. It is prohibited for unauthorized minors to access and use the portal. GOTEO assumes that from the moment in which a minor accesses the portal, he has the permission of his parents, his guardian or his legal representative.

As Internet makes possible the access to contents that cannot be adapted for minors, one informs the Users that mechanisms exist, in particular computer programs of filter and blockade, which allow to limit the available contents and, although they do not turn out to be infallible, they are of special utility to control and to restrict the materials to which the minors can gain access.

FIFTH: COOKIES AND LINKS

GOTEO informs the user that the platform uses cookies, beeing information files hosted on the user's own computer, that serve to facilitate the navigation of the user through the portal (e.g.: not to have to enter username and/or password). In no case will the cookies gather or treat information of personal character. The user has the possibility to configure your browser in such a way that it prevents the installation of these files.

GOTEO assumes no responsibility for external links, that could be included in the portal, as it does not have any type of control on them, so the user accesses under his own responsibility any content with the conditions of use governing it.

SIXTH: PRIVACY POLICY

GOTEO protects your personal data in accordance with the Data Protection Act and the Regulations on Security Measures. The information on the protection of personal data is collected in the Privacy Policy. Information about the protection of personal data can be found in the privacy policy.

To this end it has adopted the necessary measures to prevent the alteration, loss, treatment or unauthorized access of personal data, taking into account the current state of the technology, however, the user must be aware that Internet security measures are not infallible.

In the event that personal data beloning to other people will be included in the platform, prior to its inclusion they have to be informed of the contents in the Política de Privacidad.

SEVENTH: DURATION AND TERMINATION

The platform has, in principle, an indefinite lifetime. GOTEO, however, is authorized to terminate or suspend the platform at any time. When reasonably possible, GOTEO will previously communicate the termination or suspension to the community so that users can remove their contents.

EIGHTH: APPLICABLE LEGISLATION

Current regulations will determine the laws that should govern and jurisdiction about the relationships between GOTEO and users.
